Terms of Service

1. Acceptance of Terms

By creating an account or using SnapStaq, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform.

2. What SnapStaq Is

SnapStaq is a photo delivery and studio management platform. It allows photographers and creative studios ("Photographers") to organise, present, and deliver photo and video galleries to their clients ("Clients"). The platform includes gallery management, download controls, client selection tools, private cloud file storage (Stash), invoicing tools, and studio management features. SnapStaq provides the infrastructure; Photographers manage their own content and client relationships.

3. Definitions

  • "Platform" — SnapStaq and all software, features, APIs, and services operated by SnapStaq.
  • "Photographer" — any individual or business entity that creates an account and uses the Platform to manage and deliver content.
  • "Client" — any individual who accesses a gallery or file shared by a Photographer through the Platform.
  • "Stack" — a gallery created by a Photographer on the Platform.
  • "Content" — any photos, videos, files, or data uploaded to the Platform by a Photographer.

4. Your Account

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials. Do not share your password with anyone.
  • You must be at least 18 years old to create an account.
  • Each individual or legal entity may maintain only one active account. A photographer and their business may not hold separate accounts for the same studio activity. Agency or team arrangements require written permission from SnapStaq.
  • You are responsible for all activity that occurs under your account, whether or not authorised by you.

5. Photographer Responsibilities

  • You own and are solely responsible for all Content you upload to the Platform.
  • You confirm that you have the legal right to upload, store, and share all Content on the Platform, including any images or videos in which other people appear.
  • You must not upload Content that is illegal, defamatory, obscene, or that infringes on the intellectual property rights, privacy rights, or any other rights of any third party.
  • You are solely responsible for all agreements you have with your own clients regarding photo delivery, licensing, payment, and usage rights. SnapStaq is not a party to those agreements and accepts no liability arising from them.
  • You are responsible for obtaining any necessary consents from individuals featured in your Content for the use and distribution of their likeness.

6. Client Access

Clients access Stacks via links shared by Photographers. Clients may view, download, or interact with a Stack only to the extent the Photographer has permitted within their gallery settings. SnapStaq does not independently grant Clients any rights to Content beyond what the Photographer permits.

If a Photographer's account becomes restricted, suspended, or is terminated, Client access to that Photographer's Stacks may be affected or interrupted. SnapStaq is not liable for any Client access interruptions resulting from a Photographer's account status, including failure to maintain an active subscription.

7. Acceptable Use

You agree not to:

  • Use the Platform to distribute illegal, harmful, abusive, or offensive Content
  • Upload Content you do not have the legal right to use, store, or distribute
  • Attempt to access another user's account or data without authorisation
  • Abuse, overload, or attempt to interfere with the Platform's infrastructure
  • Use automated scripts, bots, scrapers, or crawlers to access or extract data from the Platform without written permission
  • Attempt to circumvent any security, access control, PIN, or subscription enforcement mechanism
  • Resell, sublicense, or redistribute access to the Platform without prior written permission from SnapStaq

8. Intellectual Property

You retain full ownership of all Content you upload. By uploading Content, you grant SnapStaq a limited, non-exclusive, royalty-free licence to store, process, optimise, and deliver that Content solely for the purpose of operating the Platform on your behalf. This licence ends when you delete the Content or close your account. SnapStaq will never use your Content for marketing, advertising, AI model training, or any purpose outside of delivering the service to you and your clients.

The Platform itself — including its software, design, features, and brand — is owned by SnapStaq. You may not copy, modify, reverse-engineer, or create derivative works of the Platform or any part of it.

9. Copyright and Content Complaints

SnapStaq respects intellectual property rights. If you believe Content hosted on the Platform infringes your copyright or other legal rights, please send a written notice to [email protected] that includes:

  • Your full legal name and contact details
  • A description of the work you believe has been infringed
  • The specific URL or location of the allegedly infringing Content
  • A statement that you have a good-faith belief that the use of the Content is not authorised by the rights holder, its agent, or the law
  • A statement, made under penalty of applicable law, confirming the accuracy of the information in your notice and that you are the rights holder or are authorised to act on their behalf

We will review all notices and respond within a reasonable time. Where a valid claim is made, we may remove or disable access to the relevant Content and notify the Photographer who uploaded it.

10. Free Trial

New accounts receive a 10-day free trial with access to all Platform features and 5 GB of cloud storage. No payment details are required to start a trial.

When your trial ends, no charge is applied automatically. You must choose a subscription plan and complete payment to continue using the Platform. If you do not subscribe before your trial ends, your account enters restricted mode: you can sign in, browse your galleries, and download your own files, but uploading, publishing, and all client-facing gallery links are suspended until you subscribe.

If no subscription is started within 30 days of the trial ending, all galleries, photos, and files associated with your account may be permanently deleted. We send reminder emails before this happens.

11. Subscriptions and Billing

SnapStaq operates on a paid subscription basis. Current plan details and pricing are available at snapstaq.com/pricing.

Plans

SnapStaq offers four subscription tiers — Core, Advanced, Pro, and Max — with varying storage allowances and feature access. Plan details are available on the pricing page.

Billing cycles

Subscriptions are available on a monthly or annual basis. Annual subscriptions are billed as a single upfront payment equivalent to ten months of the monthly price, giving you two months free per year.

Auto-renewal

Subscriptions renew automatically at the start of each billing period. You will receive an email notification before each renewal. To prevent a renewal, you must cancel your subscription before the renewal date via Settings → Billing. Cancellation stops future renewals; you retain access until the end of the current paid period.

Currency

You are billed in your local currency based on your registered market. Prices are set locally and are not subject to foreign exchange conversion or hidden fees.

Plan changes

You can upgrade or downgrade your plan at any time. Unused credit from your current billing period is applied on a pro-rata basis toward the cost of the new plan. Downgrades take effect at the end of your current billing cycle so you keep what you have already paid for.

Payment failure

If a renewal payment fails, you will receive an email notification. Your account will continue to function during a 7-day grace period. If payment is not successfully recovered within the grace period, your account enters restricted mode until payment is made.

Refunds

Subscription fees are non-refundable for unused periods, including the remaining balance of annual plans where a Photographer cancels mid-year. You retain access until the end of the period you have already paid for. This does not affect any statutory consumer rights you may have under the applicable law of your jurisdiction. No hidden fees

The price shown on our pricing page is the price you pay. There are no setup fees, platform fees, or transaction charges applied by SnapStaq.

12. Account Status After a Subscription Ends

The following applies when a subscription is cancelled, lapses, or is not renewed:

  • You retain full access until the end of your current paid billing period.
  • After the paid period ends, your account enters a 7-day grace period during which your account continues to function normally while you arrange renewal.
  • After the grace period, your account enters restricted mode: you can sign in, browse your galleries, and download your own files, but uploading, editing, publishing, and all client-facing gallery links are suspended until you renew.
  • If your account remains unpaid for 30 days after paid access ends, SnapStaq will send reminder emails and may permanently delete all galleries, photos, and files associated with your account. This includes all uploaded photos, videos, and files.
  • Billing records, invoices, and subscription history are retained as required by applicable law.
  • SnapStaq is not liable for client access interruptions or media loss resulting from a lapsed, cancelled, or unpaid subscription.

We strongly recommend keeping a local backup of all files regardless of your subscription status.

13. Service Availability

We aim for the highest uptime possible. We do not guarantee uninterrupted service. Scheduled maintenance, infrastructure issues, or circumstances outside our control may cause temporary service interruptions. SnapStaq is not liable for any loss resulting from downtime or service interruptions.

14. Account Suspension and Termination

By you: You may close your account at any time by contacting us at [email protected]. All personal data associated with your account will be permanently deleted within 30 days of your request.

By SnapStaq: We reserve the right to suspend or terminate accounts that violate these Terms, or that are associated with fraudulent, illegal, or harmful activity. Except in cases of serious harm, fraud, illegal activity, or where providing notice would compromise a security investigation, we will give you reasonable notice before suspension or termination and will give you an opportunity to download your files. If an account is terminated for cause, we may remove associated data as part of the termination process.

15. Indemnification

You agree to indemnify, defend, and hold harmless SnapStaq and its officers, employees, and agents from and against any third-party claims, damages, losses, and costs (including reasonable legal fees) arising from: (a) your use of the Platform; (b) any Content you upload; (c) any breach of these Terms by you; or (d) any claim that your Content infringes the rights of a third party.

16. Limitation of Liability

The Platform is provided "as is." To the maximum extent permitted by applicable law, SnapStaq and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform, including but not limited to loss of data, loss of revenue, loss of business opportunity, or loss of client relationships.

Our aggregate liability to you for any direct claim arising from your use of the Platform shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the claim.

17. Force Majeure

SnapStaq shall not be in breach of these Terms and shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government or regulatory authorities, telecommunications or internet infrastructure failures, cyberattacks, or the failure of third-party service providers.

18. Dispute Resolution

If a dispute arises between you and SnapStaq, we encourage you to contact us first at [email protected]. We will make a good-faith effort to resolve the dispute within 30 days of receiving your written notice.

If the dispute is not resolved within that period, either party may refer it to the Lagos Multi-Door Courthouse (LMDC) for mediation. If mediation does not resolve the dispute, either party may refer it to binding arbitration under the rules of the Lagos Chamber of Commerce International Arbitration Centre (LACIAC).

These provisions do not limit your right to contact any applicable consumer protection authority or data protection regulator in your jurisdiction.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes not resolved under the dispute resolution process in Section 18 shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

20. Changes to These Terms

We may update these Terms from time to time. We will notify you by email when material changes occur. The effective date at the top of this page will always reflect the most recent version. Continued use of SnapStaq after changes take effect constitutes acceptance of the updated Terms.
