1. Acceptance of Terms
By creating an account or using SnapStaq, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. What SnapStaq Is
SnapStaq is a photo delivery platform that allows photographers ("Photographers") to share stacks with their clients ("Clients"). Photographers manage their own content and client relationships. SnapStaq provides the infrastructure to do so.
3. Your Account
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to create an account.
- One person or business may not maintain more than one account.
4. Photographer Responsibilities
- You own and are solely responsible for all photos and content you upload.
- You confirm you have the rights to upload and share all content on this platform.
- You must not upload content that is illegal, defamatory, or infringes on third-party rights.
- You are responsible for any agreements you have with your own clients regarding photo delivery, licensing, and usage rights.
5. Client Access
Clients access stacks via links shared by Photographers. Clients may download photos only where the Photographer has enabled downloads. SnapStaq does not independently grant Clients any rights to photos beyond what the Photographer permits.
6. Acceptable Use
You agree not to:
- Use SnapStaq to distribute illegal, harmful, or offensive content
- Attempt to access another user's account or data without authorisation
- Abuse, overload, or interfere with SnapStaq's infrastructure
- Use automated scripts or bots to scrape or abuse the platform
- Resell or redistribute access to SnapStaq without written permission
7. Intellectual Property
You retain full ownership of all photos and content you upload. By uploading content, you grant SnapStaq a limited licence to store, display, and deliver that content to your intended recipients on your behalf. We will never use your photos for marketing or any purpose outside of delivering them to your clients.
8. Storage and Data
SnapStaq stores your photos on secure cloud storage infrastructure. Photos you delete are permanently removed from storage. We do not sell or share your data with third parties.
9. Subscriptions and Data Retention
SnapStaq operates on a paid subscription basis. The following applies when a subscription lapses, is cancelled, or is not renewed:
- You keep full access until the end of your paid billing period.
- After the paid period ends, SnapStaq may provide a 5-day grace period during which your account and client-facing stacks continue to work while you renew.
- After the grace period, your account may enter restricted mode. You may still sign in, manage billing, view existing account information, and delete or export your own files, but you may be unable to create new stacks, upload new files, publish, share links, send client emails, or use paid features.
- In restricted mode, public client-facing stack links, favourite links, download pages, portfolio stack links, and mobile app links may become unavailable until you reactivate a paid plan.
- If your account remains unpaid for an extended period, SnapStaq may warn you after 45 days unpaid and may permanently delete your account and storage-heavy media after 50 days unpaid. This may include originals, RAW files, videos, generated variants, cached ZIP files, and abandoned upload/session files. We may retain billing records, invoices, subscription history, and minimal audit records where needed for business, legal, tax, or security purposes.
- SnapStaq is not liable for client access interruptions or media removal resulting from a lapsed, cancelled, unpaid, or unrenewed subscription.
We strongly recommend keeping a local backup of your files whether or not your subscription is active.
10. Service Availability
We aim for the highest uptime possible, but we do not guarantee uninterrupted service. SnapStaq is not liable for any loss resulting from downtime or service interruptions.
11. Termination
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice. If an account is terminated, we may remove associated data as part of the termination process where legally permitted.
12. Limitation of Liability
SnapStaq is provided "as is." To the maximum extent permitted by law, SnapStaq and its operators are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
13. Changes to These Terms
We may update these terms from time to time. We will notify you by email when material changes occur. Continued use of SnapStaq after changes take effect constitutes acceptance of the new terms.
